1. About These Terms

These Terms of Use apply to your access to and use of the Smart Home Academy Training Portal ("the Platform").

This training platform is operated by AWE Europe Ltd ("we", "us" or "our").

By accessing, signing in to, or using the Platform, you agree to comply with these Terms of Use.

If you do not agree with these Terms, you should not use the Platform.

2. Who May Use the Platform

The Platform is intended for authorised business users, including employees, contractors, customers, dealers, installers, resellers, partners and other approved users.

You may only use the Platform if access has been granted by AWE Europe Ltd or by an organisation authorised by us.

We may refuse, suspend or remove access where we reasonably believe that:

access is no longer appropriate;
access has been requested incorrectly;
account information is inaccurate;
the Platform has been misused; or
continued access presents a security or business risk.

3. User Accounts

Your account is personal to you and must not be shared with any other person.

You are responsible for maintaining the confidentiality of your username and password and for all activity carried out using your account.

You must notify us promptly if you believe:

your account has been accessed without authorisation;
your login credentials have been compromised; or
your account information is no longer accurate.

You must ensure that your account details remain accurate and up to date.

4. Acceptable Use

You may use the Platform only for legitimate training and business purposes.

You must not:

share your account with another person;
allow another person to complete training using your account;
attempt to access courses, records, systems or data you are not authorised to access;
copy, record, download, distribute or republish training materials except where expressly permitted;
interfere with the security, performance or operation of the Platform;
upload, submit or share unlawful, offensive, misleading, harmful or inappropriate content;
attempt to bypass course requirements, assessments or completion controls;
misuse certificates, badges or completion records; or
use the Platform in a way that could damage our business, brands, manufacturers, partners, customers or other users.

5. Training Content

Training content is provided for general business training and product education purposes.

Content may include information supplied by us, product manufacturers, suppliers and business partners.

While we make reasonable efforts to keep content accurate and up to date, products, services, specifications, software and requirements may change over time.

Training content should not be relied upon as a substitute for:

current manufacturer documentation;
installation instructions;
product specifications;
safety guidance;
regulatory requirements; or
professional judgement.

Where there is any conflict between training content and official manufacturer documentation, the official manufacturer documentation should be followed.

Users remain responsible for ensuring that products are installed, configured and used in accordance with current manufacturer instructions and applicable regulations.

6. Certificates, Badges and Completion Records

The Platform may record:

course enrolment;
training progress;
assessment results;
completion status;
certificates;
badges; and
other training records.

A certificate, badge or completion record confirms only that the relevant activity has been completed within the Platform.

It does not guarantee:

competence;
professional ability;
accreditation;
product approval;
legal certification;
employment status; or
authorisation to carry out any particular activity,

unless expressly stated within the relevant course or programme.

Employers, customers and manufacturers remain responsible for determining whether an individual is suitably qualified, experienced or authorised for any specific role or activity.

Certificates and badges remain the property of the Platform and may not be altered, reproduced, misrepresented or used in a misleading manner.

We may amend, withdraw or correct certificates, badges or completion records if we reasonably believe they:

were issued in error;
were obtained through misuse;
are inaccurate; or
have been affected by a technical or administrative issue.

7. Sharing Training Records

As this is a business-to-business training platform, training information may be shared with:

authorised representatives of your organisation;
customer account contacts;
business partners; or
manufacturers whose products the training relates to.

Information may be shared for purposes including:

training administration;
accreditation;
customer account management;
channel support;
product support;
compliance activities; and
reporting.

8. Intellectual Property

All training materials, text, graphics, images, videos, documents, assessments, course structures, logos and related content are owned by, licensed to, or used with permission by AWE Europe Ltd, manufacturers, suppliers or other rights holders.

You may access and use such content solely for your own authorised training and business purposes.

Unless expressly permitted, you must not:

copy;
reproduce;
modify;
distribute;
publish;
sell;
upload;
share; or
otherwise make training content available to others.

9. Third-Party Content and Links

The Platform may include links to, or content from, third-party providers, including manufacturers and video platforms such as YouTube.

Such content is provided for convenience and training purposes only.

We are not responsible for:

the availability of third-party content;
the accuracy of third-party content;
third-party security practices; or
the terms and policies operated by third parties.

Your use of third-party services may be subject to their own terms, privacy notices and cookie policies.

10. Availability of the Platform

We aim to make the Platform available whenever reasonably possible.

However, we do not guarantee that access will always be:

available;
uninterrupted;
secure; or
error-free.

We may add, amend, update, suspend or remove:

courses;
assessments;
certificates;
platform features; or
training content

at any time and without prior notice.

Access may be affected by maintenance, updates, technical issues, security concerns or circumstances beyond our reasonable control.

11. Security and Monitoring

We may monitor use of the Platform for purposes including:

maintaining security;
investigating issues;
supporting users;
preventing misuse;
protecting the Platform; and
ensuring compliance with these Terms of Use.

You must not attempt to test, scan, bypass, damage or interfere with Platform security unless we have provided prior written permission.

12. Suspending or Removing Access

We may suspend, restrict or remove access where:

your organisation is no longer entitled to use the Platform;
your role or relationship with your organisation changes;
your account information is inaccurate;
your account has not been used for an extended period and is no longer required;
we reasonably believe these Terms have been breached;
we need to protect the security, integrity or operation of the Platform; or
we are required to do so by law, contractual obligation or manufacturer requirements.

13. Our Responsibility

The Platform is provided for business training purposes.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

Subject to that, we are not responsible for:

loss arising from reliance on outdated, incomplete or superseded training content where official manufacturer or legal documentation should have been consulted;
loss resulting from unauthorised use of your account;
loss arising from third-party websites, platforms or services;
temporary unavailability of the Platform; or
any indirect or consequential loss, including loss of profit, revenue, business opportunity or business interruption.

14. Your Organisation's Responsibilities

Where you use the Platform through an employer, customer, dealer, partner or other organisation, that organisation remains responsible for:

selecting appropriate personnel for training;
supervising users where required;
authorising activities performed by users; and
determining whether completed training satisfies its own operational, compliance, customer, manufacturer or legal requirements.

15. Account Closure

You may request closure of your account at any time by contacting us.

Closure of an account does not necessarily result in deletion of training records, certificates or related information where we need to retain those records for legitimate business, contractual, support, accreditation or legal purposes.

By using the Platform, you acknowledge that you have had the opportunity to read these notices.

17. Changes to These Terms

The latest version will always be available through the Platform.

Continued use of the Platform following any update constitutes acceptance of the revised Terms.

Significant changes may also be communicated through the Platform where appropriate.

18. Governing Law

These Terms of Use are governed by the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction over any dispute arising from or relating to these Terms, except where applicable law requires otherwise.
